Ohio High Tier OVI Thresholds & Refusal Rules

Ohio Revised Code Section 4511.19 prohibits operating a vehicle while under the influence of alcohol, drugs, or both. A High Tier allegation involves a measured alcohol level at or above an applicable statutory threshold, distinguishing it from a low-tier OVI and potentially increasing the mandatory minimum penalties.

High Test allegations under Section 4511.19(A)(1)(f), (g), (h), or (i) involve:

Blood:.17 or higher
Blood serum or plasma:.204 or higher
Breath:.17 or higher
Urine:.238 or higher

A chemical-test refusal isn’t automatically treated as a High Test offense. Under Section 4511.19(A)(2), that treatment applies when the driver has a prior OVI conviction within the preceding 20 years. A first refusal without such a prior conviction is charged at the low level for jail purposes, but it carries a longer refusal-related license suspension and waiting period.

Ohio’s implied-consent law requires a driver to submit to chemical testing after a lawful OVI arrest supported by reasonable grounds to believe the driver was impaired. Because testing and refusals fall under different statutory provisions, we examine the exact allegation rather than treating every refusal as a High Tier OVI.
